Terms and Conditions for [Disney Store e-Gift Card] 
(Disney Store APAC)


The following Terms and Conditions (“e-Gift Card T&Cs”) describe the terms and conditions that apply to the use of Disney Store e-Gift Cards, that are purchased from:

  1. the Disney Store Australia: disneystore.asia/au (“Disney Store AU”), operated by The Walt Disney Company (Australia) Pty Ltd (“Disney Australia”);
  2. the Disney Store New Zealand: disneystore.asia/nz (“Disney Store NZ”), operated by Disney Australia;
  3. the Disney Store Singapore: disneystore.asia/sg (“Disney Store SG”), operated by (“Disney SEA”); or 
  4. the Disney Store Malaysia: disneystore.asia/my (“Disney Store MY”), operated by Disney SEA,

as described herein (collectively, “Cards”). In this e-Gift Card T&Cs, a reference to “Applicable Disney Store” means the Disney Store AU, Disney Store NZ, Disney Store SG or Disney Store MY from which your Card was purchased (as the case may be). 

This e-Gift Card T&Cs is between you, the holder of a Card and therefore the owner of the Card (the “Cardholder”) or the purchaser of the Card (“Purchaser”) (as the case may be), and either Disney Australia or Disney SEA (as the case may be) (the “Issuer”). By purchasing, accepting or using your Card, you agree to be bound by this e-Gift Card T&Cs, the Applicable Disney Store’s Terms of Sale, Terms of Use and Privacy Policy (which are incorporated by reference to these e-Gift Card T&Cs). If you do not agree with this e-Gift Card T&Cs, do not purchase, use or accept the Card.

  1. About the Cards. The Cards are issued by the Issuer. The Issuer is responsible for the operation and maintenance of the Cards program. The Issuer is the sole legal obligor to the Cardholders; provided, however, that the Issuer may assign its obligations with respect to the Cards at any time, in which case such assignee shall become the Issuer and sole legal obligor to the Cardholders. To the extent permitted under applicable law, The Walt Disney Company (“TWDC”) and its affiliates (other than the Issuer) bear no responsibility or liability for the Cards, and you knowingly release TWDC and its affiliates (other than the Issuer) from any and all liabilities and claims of any nature arising in connection with the Cards. The Cards are only denominated in the local currency of the Applicable Disney Store where the Cards are offered for sale and in such amounts set out on the Applicable Disney Store site. The Cards are neither debit cards nor credit cards. For the purpose of Disney Store AU and Disney Store NZ, the Cards constitute a non-cash payment facility only and does not constitute any form of financial product or provision of any financial service. For the purpose of Disney Store SG and Disney Store MY, the Cards do not constitute e-money under applicable financial services laws and regulations. The Cards are not legal tender, account cards, credit cards, debit cards or securities. 
  2. Sale of the Cards. Notwithstanding the above, the Issuer may permit its third-party service providers or agents to act as the merchant of record in their name, in accordance with the Terms of Sale as set out on the Applicable Disney Store. Please note that as regards to the sale of Cards, in the event of conflict between the Terms of Sale and these e-Gift Card Terms and Conditions, the terms of these e-Gift Card Terms and Conditions will apply.
  3. Issuance and Redemption of the Cards. Cards may only be purchased in a standalone transaction on the Applicable Disney Store. Cards are not valid if purchased from any other seller. Cards are redeemable only for purchases of goods at the Applicable Disney Store where the Card was purchased and cannot be redeemed for any other goods or services offered by TWDC and its affiliates (other than the Issuer), such as for Disney+ subscriptions, at Disney theme parks or resorts or at Disney Store physical stores. Cards may not be used to purchase other Cards.
  4. Gifting. Cards may be purchased as gifts to a third-party recipient nominated by the Purchaser of the Card. Upon delivery via email of the Cards to the recipient, such third-party recipient shall be deemed to be the Cardholder. Purchaser warrants that it has obtained permission from the third-party recipient to share personal information (such as name, email address, etc.) with the Issuer for the purpose of issuing the Cards to such recipient, and Purchaser will not purchase a Card for a third-party recipient unless it has obtained such permission.
  5. No Cash Redemption. The value in the Cards cannot be exchanged or redeemed for cash. 
  6. Use. To use the Card, you must enter the digital redemption code linked to the Card. Such digital redemption code will be sent with the Card to the email address submitted as part of the Card purchase. Cards may be used together with other payment methods, such as credit cards, to purchase goods from the Applicable Disney Store. Up to a maximum of five (5) Cards may be used together in a single payment transaction. You may also use the Card across more than one (1) purchase transaction, to do so, you must specify the amount to be deducted from your Card in a purchase transaction, up to the value of remaining balance of your Card. 
  7. Non-Payment. The Issuer reserves the right to refuse to honour any Card purchase in the event of a disputed credit card charge, charge-back or other failure of consideration.
  8. Card Balance. Cards are issued in accordance with the amount of Card value purchased on the Applicable Disney Store, this represents the Card balance and the maximum value of the Card. Such balance does not include any value-added taxes, goods and services tax, sales tax and other applicable taxes and duties (“Taxes”) or any other transaction fees and charges such as credit card fees (“Charges”). However, the total price payable and deducted from the Card at checkout will include Taxes and Charges.
  9. Card Balance Inquiry. For Card balance inquiries, click the “Check e-Gift Card Balance” link at the bottom of the Applicable Disney Store and fill in your Card details and email address. MyDisney account holders may opt-in to have your Card balance linked to your MyDisney account; once linked, log into your MyDisney account to view your Card balance. The balance obtained by a Cardholder when inquiring online is an estimate only. In most cases, the balance is adjusted immediately when a Cardholder makes a purchase, but there may be occasions when the balance adjustment is delayed.
  10. Expiry. Cards purchased from Applicable Disney Stores are valid for a period of three (3) years from the date of purchase and expire one day before the date which is the third anniversary of the date of purchase. Cardholders may check the expiry date by referring to the Card delivery email sent from the Applicable Disney Store. Upon expiration, the Card will be void, and any remaining balance will be forfeited.
  11. No Fees. No activation, inactivity or service fees such as for account-keeping or balance enquiries apply to any Card.
  12. Not Reloadable. Cards may be used multiple times to make purchases on Applicable Disney Stores provided there is still remaining balance in the Card. Cards may not be reloaded with value.
  13. Cancellations, Refunds and Returns. Once issued, your Card cannot be cancelled by you and the Cards are not refundable, except as required by applicable law. For the avoidance of doubt, Cards may not be refunded for a change of mind. Products purchased using a Card will be subject to the Applicable Disney Store Returns Policy, Terms of Sales or Terms of Use (“Returns Policy”). If you use a Card to make a purchase on an Applicable Disney Store and such goods are subsequently refunded or returned in accordance with the Returns Policy, Issuer will issue you a new Card for the refund amount. If you use a combination of Cards and another payment method to make a purchase and the goods are subsequently returned in accordance with the Returns Policy, the amount to be refunded will be returned to such other payment methods first (up to a maximum of the amount paid using such other payment method) and a new Card will be issued for the balance refund amount. 
  14. Issuance of New Card. Any new Cards issued by the Issuer may only be sent to the recipient email address submitted by the Purchaser to the Applicable Disney Store at the time of original purchase. New Cards issued will have a new validity period and expiration date. 
  15. No Resale. The Cards may not be resold. If the Card is obtained from an unauthorized seller or reseller, including through any Internet auction site, such Card is not valid and will not be honoured, and the Issuer will not be liable for the amounts paid and the value of the Card.
  16. Lost or Stolen Cards. If a Cardholder misplaces or loses the digital redemption code or Card number which is required to redeem their Card balance, please visit customer support center or contact the Issuer via our support team at service@Global-e.com. The Cardholder may be required to provide proof of purchase and identity documentation. The Issuer is not responsible for stolen or unauthorized use of any Card.
  17. Fraud. The Issuer reserves the right to cancel, void or refuse to honour a Card if the Issuer suspects that the Card was obtained fraudulently or there is any other suspected misuse of the Card.
  18. Limitation of Liability. TO THE EXTENT PERMITTED UNDER APPLICABLE LAW, THE ISSUER AND ITS AFFILIATES MAKE NO WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO THE CARDS, INCLUDING, WITHOUT LIMITATION, ANY EXPRESS OR IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IN THE EVENT THAT A CARD IS NON-FUNCTIONAL, TO THE EXTENT PERMITTED UNDER APPLICABLE LAW, YOUR SOLE REMEDY, AND THE SOLE LIABILITY OF THE ISSUER AND ITS AFFILIATES, SHALL BE THE REPLACEMENT OF SUCH CARD. NOTHING IN THIS SECTION IS INTENDED TO OVERRIDE APPLICABLE CONSUMER LAWS WHICH DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS OR LIMITATIONS MAY NOT APPLY TO YOU.
  19. Governing Law. If you purchased your Card from the Disney Store AU or NZ, the laws of Victoria, Australia, without regard to principles of conflict of laws, shall govern this Gift Card T&Cs and the use of your Card and the parties agree to submit to the exclusive jurisdiction of the Courts of Victoria, Australia. If you purchased your Card from the Disney Store SG or MY, the laws of Singapore, without regard to principles of conflict of laws, shall govern this e-Gift Card T&Cs and the use of your Card and the parties agree to submit to the exclusive jurisdiction of the Courts of Singapore.
  20. Changes to these Terms. The information in these Terms and Conditions for Disney Store e-Gift Cards is current as at the date stated at the beginning of this document. The Issuer may change, add to or delete the terms and conditions in this document at any time. The Issuer may only change these terms and conditions in a way that materially reduces or limits your rights under these terms and conditions if the Issuer is required to do so by law, where such changes are imposed on it by third party suppliers or where the change is otherwise required to protect its legitimate business interests. If any such change is made, such changes will be emailed to the original purchaser of the Card no later than the date when the changes take effect, unless a relevant law requires more advance notice to be provided to you.
  21. Severance. Notwithstanding anything herein to the contrary, if any part of this e-Gift Card T&Cs is deemed invalid or inapplicable, such provision shall be modified or restricted to the extent and in the manner necessary to render it valid, legal and enforceable. If such provision cannot be so modified or restricted, it shall be excised from this e-Gift Card T&Cs without affecting the validity, legality or enforceability of the remainder of this e-Gift Card T&Cs, which shall be fully enforced.
